If you are looking for an IU Fort Wayne Title IX lawyer after receiving notice of a sexual misconduct complaint, first identify the policy route stated in your notice. This page explains the current public UA-03 procedures in general terms. It does not calculate your personal deadlines and is not legal advice.

A Note on IU Fort Wayne’s History

IU Fort Wayne is a present-day campus separate from Purdue Fort Wayne. According to IU Fort Wayne’s history page, IPFW was reorganized into two separate universities on July 1, 2018. For an IU Fort Wayne notice, check the IU policy it identifies rather than borrowing Purdue’s rules. Confirm which institution and office issued your notice; an older incident may require a policy-version check.

Which Policy Applies

The current public IU policy for sexual misconduct is UA-03, Discrimination, Harassment, and Sexual Misconduct. It shows a last-review date of June 26, 2025. That date does not establish which version applies to an earlier incident. Which version applies to you can depend on the date of your incident or report and on what your notice says. Ask the office handling your case which version and route it is using, and compare the answer with your notice.

IU also maintains a separate Student Code, STU-00, last reviewed the same date. It points sexual misconduct complaint resolution to UA-03. Do not substitute the Student Code’s ordinary hearing or appeal rules for a complaint proceeding under UA-03.

Report vs. Formal Complaint

Not every report becomes a formal Title IX complaint. Under UA-03, Section V describes the formal-complaint screening for the Title IX process. If a student complaint proceeds on that route, Section VI describes the resolution process. If the stated Title IX conditions are not met, the complaint must be dismissed from that route but may be assessed under Section VIII or another applicable procedure. Dismissal from one route does not automatically end every university process.

This distinction matters because Section VI and Section VIII have different rules, including different questioning procedures at hearing. Read your written notice closely to see which section the university says applies to you, since the two routes are not interchangeable.

Early Steps After You Receive Notice

If you are named as a respondent, IU Fort Wayne’s sexual misconduct page and submit-report page are campus resources for reporting options. The campus page lists some officials at other IU campuses, so confirm the recipient named in your own notice before sending case materials. Do not delay responding to a notice; UA-03 periods run from different events.

Early on, read the notice carefully to confirm which section of UA-03 applies, whether it names Section VI, Section VIII, or another procedure, who issued the notice, and what response is expected of you and by when.

Investigation and Evidence Under Section VI

For the student Title IX process under Section VI, UA-03 requires written notice of the allegations and an opportunity to respond. Following the investigation, each party and advisor receives a Preliminary Investigation Report and Investigation File, with 10 calendar days to provide additional or clarifying information to the investigator. Check the transmission date and instructions in your case materials.

Later, the final report and file go to the parties at least 10 days before the scheduled hearing. UA-03’s definitions say unqualified "days" mean calendar days unless business days are specified. This prehearing period is therefore calendar days under the current text.

These are two separate clocks tied to two separate events: one runs from your receipt of the preliminary report and file, the other runs backward from the hearing date. Do not treat them as the same deadline.

Advisor and Hearing

Under Section VI, each party must have a Hearing Advisor to question other parties at the hearing. If you do not name one in advance, IU appoints one, but it does not promise that person will be an attorney. An outside advisor is at the party’s expense. Ask about the advisor’s role before the hearing.

A three-person panel decides the responsibility determination at the hearing. This questioning structure applies to the Section VI Title IX track; Section VIII’s student university sexual misconduct process uses a different questioning rule, so do not assume the two procedures work the same way.

Supportive Measures

UA-03 offers supportive measures appropriate to the circumstances, including possible academic or living adjustments. Those measures can be offered without a formal complaint, and both parties are offered them when a formal investigation starts. Ask the office handling your case what is available; the policy does not promise a particular measure in every case.

Appeals

Appeal rights differ depending on which stage and which section of UA-03 is in play. Keep these separate:

  • Section VI hearing-decision appeal: written notice of appeal must be submitted no later than 10 calendar days after the written hearing decision is sent. The other party has a separate 5-calendar-day response opportunity after notice of the appeal.
  • Section V dismissal appeal: after a Title IX dismissal notice is given, either party may appeal to the designated official within 10 days. UA-03’s global definition makes that a calendar-day period in the current text. The dismissal and hearing-decision notices are separate triggers.

Grounds for appeal under Section VI are limited by the policy. Because deadlines and grounds vary by which notice you received, check your specific written notice for the assigned route, the recipient office, and the exact clock that applies to you.

FAQs

Does the same appeal deadline apply to a dismissal and a responsibility decision?
No. A Section V dismissal appeal and a Section VI responsibility appeal are separate processes with separate 10-day periods tied to different triggering notices. Confirm which one applies to your situation.

Will IU give me an attorney as my hearing advisor?
If you don’t choose your own advisor, IU will appoint one, but the policy does not guarantee that person will be an attorney.

Is IU Fort Wayne the same as the former IPFW?
No. IPFW was reorganized into IU Fort Wayne and Purdue Fort Wayne effective July 1, 2018. A current IU Fort Wayne notice should be checked against the IU policies it names. An older incident still requires a version check.

Does the Student Code (STU-00) govern my sexual misconduct case?
STU-00 points sexual misconduct resolution to UA-03. Check your notice for the assigned route rather than using the ordinary Student Code appeal clock.

What if my complaint gets dismissed from the Title IX process?
UA-03 permits assessment under the university sexual misconduct procedure or another applicable process after a Title IX dismissal. Ask what written notice will identify the next route.

Where do I find current deadlines and procedures?
Read your written notice and the applicable UA-03 text. Public summaries may not capture every distinction between tracks or establish which policy version applies to an older incident.
